Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the websites and services of ConstructiveCore, LLC, a Georgia, USA company (“ConstructiveCore,” “we,” “us”) — including this website and the ConstructiveCore construction management platform (the “Service”). Use of the Service’s software is additionally governed by our End-User License Agreement, and our data practices are described in our Privacy Policy. By using the Service you agree to these Terms.
1. Accounts and Organizations
You must provide accurate information when creating an account and keep your credentials confidential. Accounts belong to the Customer organization that created or invited them; organization administrators manage users, roles, and permissions. You are responsible for activity under your account.
2. Subscriptions and Billing
Paid features are provided under a subscription. Fees, billing periods, and included usage are stated at purchase or in your order. Unless otherwise agreed, subscriptions renew automatically until cancelled, and fees are non-refundable except where required by law. Online payments are processed by Stripe; late or failed payment may result in suspension after reasonable notice. Prices for renewals may change with advance notice.
3. Acceptable Use
You agree not to misuse the Service — including attempting unauthorized access, probing or disrupting our infrastructure, transmitting malware, infringing others’ rights, sending spam through Service features, or using the Service in violation of law. We may suspend accounts that put the Service or other customers at risk.
4. Customer Content
Your organization retains ownership of the data and content it enters into the Service, as described in the EULA. You are responsible for that content and for having the rights and consents needed to use it in the Service (including photos and time clock records collected from your workers).
5. Third-Party Services
Features that connect to third-party services (such as QuickBooks Online, Stripe, Google, or Microsoft) depend on those providers and are subject to their terms. We are not responsible for third-party services, and an interruption on their side is not a breach of these Terms.
6. Availability and Support
We work to keep the Service available and performant, but the Service is provided without an uptime guarantee unless one is set out in a separate written agreement. We may perform maintenance, and we may modify features as the Service evolves. Support is available at support@constructivecore.app.
7. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for material breach, non-payment, or unlawful use. Sections concerning ownership, disclaimers, liability, and governing law survive termination. Data export and deletion after termination are handled as described in the EULA and Privacy Policy.
8. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSTRUCTIVECORE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA; AND OUR TOTAL LIABILITY WILL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.
9. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted at this page with a revised “Last updated” date; material changes will be communicated to Customer administrators. Continued use of the Service after changes take effect constitutes acceptance.
10. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Georgia.
